Omni / 15 Great Road Decisions

On November 18, 2013 the Zoning Board of Appeals received an application from Fifteen Great Road II, LLC, for changes to the comprehensive permit previously approved by the ZBA for 15 Great Road. The ZBA met on Thursday November 21, 2013 and determined the changes were "substantial" and scheduled a public hearing. The ZBA opened the public hearing on December 12, 2013 on proposed changes to the Comprehensive Permit for the 15 Great Road 40B project. The public hearing was continued December 19, 2013, January 7, February 12 and March 3, 2014 at 7:15 pm.

15 Great Road Decision

On March 3, 2014, the Zoning Board of Appeals voted [4 to 1] to approve a comprehensive permit for 200 housing units at 15 Great Road. The 40B project consists of 144 rental and 56 ownership units. The decision was filed with the Littleton Town Clerk on March 4, 2014.

On February 14, 2013, the Zoning Board of Appeals voted unanimously to approve a 40B comprehensive permit (PDF) for 190 rental housing units at Village Green Apartments, 15 Great Road; and the Planning Board unanimously approved an "open space" special permit and 40A definitive subdivision plan for The Orchards.

On February 11, 2013, the Board of Selectmen voted to execute a host community agreement (PDF) with Fifteen Great Road, LLC, and various owners of the property at 15 Great Road, Littleton, ("the developer") which provides for mitigation payments to the Town by the developer relative to proposed developments at 15 Great Road including the comprehensive permit application for Village Green Apartments pending before the Zoning Board of Appeals under MGL Chapter 40B, and the proposed Orchards subdivision pending before the Planning Board under MGL Chapter 40A; and which agreement provides assurance that the Town's subsidized housing inventory remain above 10% through the 2030 Census update (in 2031) in the event that some of 15 Great Road's rental units were subsequently converted to ownership; said agreement to be subject to approval as to form by Town Counsel. 

Comprehensive Permit Application Procedural History

On February 16, 2012, the Zoning Board of Appeals received an amended comprehensive permit application from Fifteen Great Road II LLC for 200 rental units at 15 Great Road. A public hearing opened on Monday, March 5, 2012 continued on Thursday, May 17, June 21, July 12, August 16, September 13, October 18, November 15, December 13, December 18 and January 17, 2013. The ZBA closed the public hearing on January 17, 2013. On February 14, 2013, the Zoning Board of Appeals voted unanimously to approve a 40B comprehensive permit for 190 rental housing units at Village Green Apartments, 15 Great Road, the decision (PDF) was filed with the town clerk on February 21, 2013.

Previous site visits to the 15 Great Road property were conducted on Saturday, October 1, 2011 at 11 am and Sunday, October 16, 2011 at noon.

On August 18, 2011, Fifteen Great Road II, LLC filed a comprehensive permit application for 200 rental units at 15 Great Road, Littleton. File copies, including plans, are available for inspection at the Board of Selectmen's office, 37 Shattuck Street, Littleton. The Zoning Board of Appeals first began its public hearing on Fifteen Great Road II LLC's original comprehensive permit application on Tuesday, September 27, 2011 at 7:15 pm with a PowerPoint presentation (PDF) made by the applicant. The ZBA hearing continued on Wednesday, October 12, October 20, November 17, and December 15, 2012, January 19, and February 16, 2013. On March 26, 2011, Fifteen Great Road II LLC filed an application with MassDevelopment for a determination of project eligibility for a proposed 40B project at 15 Great Road. On May 23, 2011, the Board of Selectmen voted unanimously to authorize submission of the municipality's written comments (PDF) in opposition to that proposal. On June 30, 2011, MassDevelopment issued a project eligibility letter (PDF) that allowed the applicant to submit a comprehensive permit application to the Zoning Board of Appeals.

Revised Preliminary Subdivision Plan

On March 22, 2012, a revised preliminary subdivision plan was filed with the Planning Board for 15 Great Road. See the plan in the "preliminary subdivision". On July 11, 2011, Omni had granted a further extension until September 15th (PDF) for the Planning Board's review of the preliminary subdivision plan for 15 Great Road filed on May 13, 2011. Groundwater Discharge Permit

On July 17, 2012 a presentation (PDF) was made to the Board of Health on the wastewater treatment system. On October 22, 2013 a Draft Groundwater Discharge Permit (PDF) was sent to Fifteen Great Road, LLC for review, on January 15, 2014 a revised final groundwater discharge permit was issued.
