MassWorks Route 119 (Great Road) / I-495 Interchange Traffic Mitigation Project

On May 14, 2012, the Board of Selectmen voted to execute a Memorandum of Agreement with Littleton Commercial Investments, LLC (Developer), which sets forth the agreement between the Town and the Developer with respect to the Developer's construction of a mixed use commercial development on Constitution Avenue, and the Town's construction of the MassWorks Route 119 (Great Road)/I-495 Interchange Traffic Mitigation Project; and further to establish a special gift fund account, pursuant to MGL C.44,§53A, the proceeds of which shall be used without further appropriation by the Board of Selectmen to fund said project, and to receive a gift of $609,630 from Littleton Commercial Investments, LLC. for this purpose. Said gift will be conditioned upon the understanding that if the contract price is reduced due to change order or cancellation of the contract, the unused funds will be returned to Developer.

On May 20, 2013, the Board of Selectmen voted to authorize the Town Administrator to execute an amended Memorandum of Agreement with Littleton Commercial Investments, LLC (Developer), which sets forth the agreement between the Town and the Developer with respect to the Developer's construction of a mixed use commercial development on Constitution Avenue, and the Town's construction of the MassWorks Route 119 (Great Road)/I-495 Interchange Traffic Mitigation Project; and to receive a further gift of $299,698 from Littleton Commercial Investments, LLC, to be deposited in the special gift fund established by vote of the Board on May 14, 2012 to fund said project.

On August 11, 2014, the Board of Selectmen voted to authorize the Town Administrator to execute a second amendment to the Memorandum of Agreement with Littleton Commercial Investments, LLC, which sets forth the agreement between the Town and LCI with respect to LCI's construction of a mixed use commercial development on Constitution Avenue, and the Town's construction of the MassWorks Route 119 (Great Road)/I-495 Interchange Traffic Mitigation Project; and to receive a further gift of $120,000 from LCI to be deposited in the special gift fund established by vote of the Board on May 14, 2012 to fund said project. [This brought LCI's total donations for this project to $1,029,328.]
